California’s Statute of Limitations for Personal Injury
You have one year from the date of your injury to file a personal injury lawsuit in California. This deadline is strict. According to California Code of Civil Procedure Section 335.1, missing this deadline means losing your right to compensation forever.
Some exceptions exist, however. So even if you think you’ve missed the deadline, give us a call.
- For any personal injury or wrongful death claim against a public entity or public employee, (negligence, malpractice or otherwise) each person seeking to make a claim must serve a formal written Governmental Claim on each and every governmental entity believed to be responsible within 6 months (six months) of the date of the incident, or if for wrongful death within 6 months (six months) of the date of death.
- In personal injury or wrongful death actions against private persons and or entities, California’s Statute of Limitations provides you must file a formal complaint that meets legal requirements with a proper court within 2 years. (See Civil Procedure Section 335.1)
- In medical malpractice claims against any public entity, you must conform to (A) above. In medical malpractice claims against any private party or entity, the California Code of Civil Procedure Section 340.5 which states that a formal written complaint naming each and every medical provider must be filed “within one year after the plaintiff discovers, or through the use of reasonable diligence should have discovered, the injury”
