Was the Recalled Product in Your Home Already an Injury Case?

A dresser that tips. A teething toy that chokes. A mattress that catches fire. The Consumer Product Safety Commission just pulled several household items off shelves for exactly these hazards, and a refund does not undo an injury that already happened.
If a defective product hurt you or your child before the recall notice reached you, that refund is not the end of the story.
At William D. Shapiro Law, Inc, our San Bernardino defective product attorneys investigate defective products and fight to get injured Californians full compensation. Call us at 909-890-1000 or fill out our confidential contact form to schedule a consultation.
What Products Were Just Recalled
This batch of recalls covers more ground than most people expect. EnHomee 9-drawer fabric dressers, sold on Walmart.com by Raybee-Direct, failed federal STURDY Act stability testing and can tip onto a child. A separate 12-drawer fabric dresser carries the same tip-over and entrapment risk.
Aojieni “Sili Factory” pull-string teething toys failed mandatory toy safety standards and pose a choking hazard for infants.
TRWZINY 12-inch mattresses failed flammability testing, and Mikrdoo children’s pajamas failed the flammability rules meant to keep sleepwear from catching fire.
Lakkzoom immersion water heaters can ignite when the unit runs dry, and certain Panasonic electric toaster ovens have a power cord that presents a shock hazard.
What To Do If You Own One of These Products
Stop using the item today, even if nothing has gone wrong yet.
- Check the model or lot number against the official recall notice
- Photograph the product and keep the box or receipt if you still have it
- Contact the manufacturer directly for the refund, repair, or replacement offered
- Anchor any dresser or bookcase to the wall until you can return it
- Seek medical care right away if anyone was hurt, and keep every record from that visit
Tip-overs alone injure an estimated 17,800 people a year, and children under 18 account for 44 percent of those injuries, according to a 2024 Consumer Product Safety Commission report. That is not a rare event. It is a pattern the agency has tracked for more than a decade.
Contaminated Medications Made the List Too
Furniture and toys were not the only problem this month. The FDA announced a nationwide recall of four lots of generic cetirizine, the allergy medication sold as Zyrtec, after tablets showed possible cross-contamination with ranitidine during manufacturing. People sensitive to ranitidine can develop severe allergic reactions, including anaphylaxis.
A separate recall pulled specific lots of Gas-X Extra Strength Softgels over possible contamination with industrial coolant, and earlier this year a distributor recalled lots of Tylenol, Advil, Bayer Aspirin, Claritin, DayQuil, NyQuil, Pepto-Bismol, Tums, and Halls after they were stored in a facility with rodent and bird contamination.
- Cetirizine lots GY825029 through GY825032, expiring October 2028
- Gas-X Extra Strength Softgels, specific lots only
- Select lots of common cold and allergy brands distributed through one wholesaler
When a Recall Turns Into a Product Liability Claim
A recall fixes the product going forward. It does not pay for the emergency room visit, the surgery, or the weeks of missed work that already happened.
Under California law, a product liability lawyer does not need to prove the manufacturer was careless. The law asks a narrower question: was the product defective, and did that defect cause your injury? That standard exists because you cannot inspect a dresser’s internal bracing or test a medication for contamination before you buy it. The manufacturer carried that responsibility, not you.
Here is what most people miss. Accepting a refund does not waive your right to also pursue a separate injury claim. Every product liability attorney at our firm has seen companies process refunds and injury claims as two completely separate tracks, and families who only ask for the refund often leave real compensation on the table.
What a Defective Product Claim Can Recover
A successful claim can cover medical bills already paid, future treatment your doctor expects you will need, lost income while you recovered, and compensation for pain and the disruption to your family’s daily life. For a child hurt by a tip-over or a choking hazard, that can also mean the cost of long-term care.
Our product liability lawyer team has spent decades tracing these costs, so families are not stuck absorbing them alone. Learn more about our firm, which has recovered hundreds of millions of dollars for injured clients across Southern California, though past results never guarantee a future outcome.
How Long You Have to Act in California
California gives you two years from the date of injury to file a product liability lawsuit under California Code of Civil Procedure Section 335.1. When an injury was not obvious right away, such as a slow-developing reaction to a contaminated medication, the clock can start from when you reasonably discovered the harm instead. Either way, waiting costs you. Products get thrown away, receipts disappear, and memories fade faster than most people expect.
Every recall this month is a reminder that safety testing sometimes fails after a product is already sitting in your home. That is not something you caused, and it should not be something you pay for alone. Whether you need help sorting out a refund or you are dealing with a real injury, a plain conversation with a product liability law firm costs you nothing.
